Notice of Adoption of By-law to Change Ward Boundaries and Council Composition (August 2023)

Please take notice that the Council of The Corporation of the Municipality of Neebing, at its regular meeting held on August 16, 2023, passed By-law 2023-034 to change the ward boundaries and Council composition, pursuant to Section 222 of the Municipal Act, 2001.

Effects of the change:

Under the current composition, there are seven (7) members of Council, made up of a Mayor, a Councillor elected at large, and five (5) ward Councillors (one each for electoral wards made up of the geographic townships of Blake, Crooks, Pardee, Pearson and Scoble).

In November 2021, By-law 2021-043 was passed which changed Council composition to include five (5) members of Council, made up of a Mayor and four (4) ward Councillors (one each for electoral wards made up of the four geographic townships of Blake, Crooks and Scoble; and one for the combined geographic townships of Pardee and Pearson).

By-law 2023-034 repeals By-law 2021-043and maintains the current structure and ward boundaries.

How to appeal:

Under Subsection 222(4) of the Municipal Act, 2001, any person or agency may appeal to the Ontario Land Tribunal (OLT) by filing a notice of appeal with the Clerk-Treasurer of the Municipality of Neebing.
The Notice of Appeal must:
  • be filed within 45 days of the by-law being passed;
  • set out the objection to the by-law and the reasons in support of the objection; and
  • be accompanied by the fees required by the Ontario Land Tribunal (certified cheque or money order payable to the “Minister of Finance”).
The by-law will not take effect or be in force until after the appeal period has passed without an appeal, or, in the case of an appeal, until after the appeal has been heard.  If there are no appeals, the by-law will take effect for the 2026 Municipal election.

For the by-law to be effective for the 2026 election, one of the following must occur:
  • No notices of appeal are filed;
  • If notices of appeal are filed, they are withdrawn before January 1, 2026; or
  • If notices of appeal are filed, the Ontario Land Tribunal either affirms or amends the by-law before January 1, 2026.
If the by-law comes into force after January 1, 2026, then it will be effective for the 2030 election.

The deadline to file a notice of appeal is Monday, Monday, October 2, 2023 at 5:00 pm.

 Council Composition Consultation Information

In the fall of 2019, the Municipality published a series of articles seeking input from residents regarding the composition of Council. As the current term of Council is nearing an end in 2022, Council is interested in providing another opportunity for residents to provide input on the composition of Neebing’s Council.

In the 2019 articles, we explained the differences between elections “at large” and elections by geographic ward. In addition, we looked at the possibility of reducing the size of Council from seven to five members. Over the next couple of months, we will provide different opportunities for members of the public to provide feedback on the size and make up of Neebing’s Council.

NEW - It has been proposed that Neebing Council be reduced to 5 members by removing the seat for Councillor-at-Large and having one seat for Pardee and Pearson combined. The Blake, Crooks and Scoble Wards would remain the same. Please complete the follow-up survey to provide your input on this proposed Council Composition.

Comments can be submitted by one of the following methods by 12:00 pm (noon) on Wednesday, November 3, 2021:

  • Complete the online survey
  • NEW - Complete the online follow-up survey
  • Submit written comments using the PDF Version of the Survey by:
    • Email: clerk@neebing.org
    • Fax:  807-474-5332
    • Mail or hand deliver to: 4766 Hwy 61, Neebing, ON   P7L 0B5
  • NEW - Attend the Council Meeting being held at 6:00 pm on November 3, 2021. You can attend the meeting either online or by phone. (This is the final meeting where Council Composition will be reviewed, which follows public meetings held September 29 and October 27, 2021.)

Your feedback is important!  These are the questions we are asking:

  1. Is it important to you to have a “ward councillor”, elected to represent your geographic township’s interests?  Or would you be comfortable having all Council members elected “at large”?
  2. If you are a fan of the “ward councillor” system, are you comfortable with the way the wards are drawn up?  Or do you think the ward boundaries should be changed?  If so – how do you think they should be changed?
  3. Are you comfortable with a 7-member Council when most other rural municipalities opt for 5-member Councils?

If you have not seen the previous articles or would like a refresher, they are posted below. Alternatively, contact the office, and we can make paper copies of these articles available to you.

We look forward to your input. Make your voice heard on this important matter.
